Plaintiff instituted this action by filing a writ of summons on April 8, 1996.1

*362Defendants are the East Hempfield Township Police Department, its chief of police, Douglas Bagnoli, and one of its officers, Dennis Eberly. Ms. Jackson contends in her complaint that defendants violated her constitutional rights of due process and equal protection by failing to properly and adequately respond to domestic violence calls involving Ms. Jackson and her husband. Specifically, plaintiff has brought this action pursuant to the provisions of 42 U.S.C. §1983.2
