Shaw sued for a sum alleged to be due him for commissions as a real-estate broker. He claimed that the defendant *461had listed a farm with him for sale, with the understánding that he might have all he could obtain above $5,000 as commissions, and that, if he could not sell it for more than $5,000, the defendant would pay a commission of 5 per cent, on a sale for that amount.
