MEMORANDUM OPINION
(July 29, 2011)
In this appeal, we address whether the Virgin Islands aggravated assault statute violates the Equal Protection Clause of the Fourteenth Amendment to the Constitution. For the reasons cited below, we remand.
I. FACTUAL AND PROCEDURAL BACKGROUND
On May 2, 2005, Mrs. Tracia Walters-Simmonds (“Mrs. Simmonds”) went to the Schrader Command police station on St. Croix to complain that her husband, Gary Simmonds (“Mr. Simmonds”, “Simmonds” or “Appellant”) had struck her.
