Robert Thornton was indicted on four counts of theft by taking 1 (Counts 1, 2, 6, and 7), and a single count each of entering an automobile with intent to commit theft 2 (Count 3), criminal damage to property in the second degree 3 (Count 4), and making false statements 4 (Count 5). Following a jury trial, Thornton was convicted on all counts, and he now appeals from the denial of his motion for a new trial.
