This is an appeal by the defendant from an order denying his motion to vacate and set aside the judgment and for leave to file an answer in the action. The summons was served on the 5th day of December, 1902, and, no answer being filed and no appearance on the part of the defendant, the case was tried to a jury on the 27th day of January, 1903, and, the verdict having been in favor of the plaintiff, a judgment was rendered thereon.
