This is a suit to restrain the city of St. Paul, its mayor, treasurer, and comptroller, from the delivery of $99,000 of bonds of the city to construct an armory for the use of that part of the National Guard stationed in St. Paul. This appeal comes here upon an order holding, upon demurrer, that the complaint sets forth a; good %ause of action. This pleading alleges, substantially, that plaintiff is a taxpayer; that the St. Paul Armory Association is a part of the National Guard, organized under the laws of this state; that it had offered to deed a valuable lot to the city upon condition that…
