MEMORANDUM OPINION AND ORDER

NOWLIN, District Judge.

In this-cause, named Plaintiffs, mentally retarded and physically disabled children who are Medicaid recipients eligible under Texas law for placement in intermediate care facilities for the mentally retarded (ICF-MRs), challenge the reimbursement rate scheme for ICF-MRs in the State of Texas administered by the Defendants under the federally funded Medicaid program.
