This is an appeal from a judgment dissolving a temporary restraining order, denying plaintiff’s request for a preliminary injunction, and awarding damages and attorney fees to the defendant. The plaintiff, Edna Steward Kinchen, filed suit to rescind a partition and sale and asked for a temporary restraining order restraining and enjoining the defendants from encumbering or transferring a part of the lands in question and further asked for a preliminary injunction.
