Former Missouri inmate Tyrone Buckley appeals the district court’s 1 adverse grant of summary judgment as to Correctional Medical Services, Inc. (CMS) in his 42 U.S.C. § 1983 action. In the lawsuit, Buckley claimed that CMS had been deliberately indifferent to his serious medical need in that recommended elbow surgery had been repeatedly cancelled and delayed. 2 Following our de novo review, we conclude that summary judgment as to CMS was proper. See Jolly v. Knudsen, 205 F.3d 1094, 1096 (8th Cir.2000) (standard of review).
