I. INTRODUCTION

The matter before the Court is a Motion for Summary Judgment filed by the Plaintiff, Edwina Brooke-Petit (the “Plaintiff’), with respect to her two-count “Complaint to Determine Dischargeability” pursuant to 11 U.S.C. §§ 523(a)(2) and 523(a)(6). The Debtor, Robert Spagnuolo, Jr., d/b/a Spagnuolo Construction (the “Defendant” or the “Debtor”), filed an Opposition to the Motion and a Cross-Motion for Summary Judgment on Count II, Nondischargeability — 11 U.S.C. § 523(a)(6).
