WOOD, District Judge.
Jurisdiction in this case is based on diversity, and the amount in controversy is in excess of $3,000. Plaintiff Howard Smith sustained injuries to his hand and lower arm requiring amputation. He was an employee of Holiday Frosted Food Company, third-party defendant. At the time he received his injuries he was operating a meat-grinding machine designed and manufactured by the Hobart Manufacturing Company, original defendant.
