This was an action for damages on account of the alienation of the affections of the wife of the plaintiff. The peti*818tion alleged various acts of illicit intercourse between the defendant and the plaintiffs wife; and taken as a whole, it is clearly a suit growing out of the alleged continued adultery of the two. The jury returned a verdict for the plaintiff for $500. The defendant made a motion for a new trial, which was overruled, and he excepted.
