Judgment reversed on the law and facts and indictment dismissed. Memorandum: On December 20, 1969 Chester Liskiewicz was stabbed and died a few days later in a Buffalo hospital. Defendant, Frank Sanders, and two codefendants were charged with common-law murder, felony murder and attempted robbery in the first and second degrees. Following a jury trial, one codefendant (Reese) was found guilty of murder and attempted robbery in the first degree, the other codefendant (Spell) was acquitted, and defendant Sanders was found guilty of assault in the second degree (under the felony-murder count)…
