MEMORANDUM AND ORDER

BLOCK, District Judge.

Pending before the Court is a motion by defendant Anthony Casso (“Casso”), a former underboss and consigliere in the Ludi-ese crime family, for specific performance of his 1994 cooperation agreement. The government contends that it is not obligated to file a motion for a reduced sentence pursuant to § 5K1.1 of the Sentencing Guidelines because, inter alia, Casso committed crimes during the term of the cooperation agreement. 1 Casso contends that the government is acting in bad faith in seeking to disavow its obligation to file the § 5K1.1 motion.…
