O’Donnel and others, as commissioners of taxes and assessments of the city of New York, from an order of the Supreme Court, made at the New York Special Term and entered in the office of the clerk of the county of New York on the 26th day of May, 1905, denying the defendants’ motion to quash a writ of certiorari theretofore issued herein.

The petition upon which the writ issued shows that petitioners Emma L. Moller and Isaac' P.
