This is an action to recover of defendants the sum of $200, which, it is alleged, they received from the plaintiff as part of the purchase money of certain real estate, which they contracted as agents of one "Walker to sell and convey to the plaintiff, and which contract of sale was never consummated, because defendants did not and could not give the plaintiff possession of the land.
