On July 28, 1939, Willie Gray, plaintiff in error, hereinafter referred to as defendant, was indicted by a grand jury of Duval County, Florida, for murder in the first degree for the unlawful killing of Ralph Wynn in Duval County on June 25, 1939. The defendant filed a plea in bar to a prosecution under the indictment on the part of the State of Florida, but with the approval of the trial court, withdrew the same and filed a plea in abatement raising the point that the grand jury of Duval County rendering the indictment against the defendant was not only summoned but was organized by the…
