The controversy in this case arises out of the same facts as in the case of Reed v. Bartlett, decided at the last May term, and reported in 9 Bradwell, 267, where they are so fully stated as to obviate the necessity of a repetition here. Hitchcock, the purchaser at the mortgage sale, brought this suit for the recovery of the first installment of rent due from the appellant to Garfield and Wolf, under the lease made by them to him, after the mortgagor Wolf had conveyed to them his equity of redemption, and recovered in the court below, and the defendant there brings the record here by appeal.
