I. The Facts and Proceedings.
On February 23, 1961, plaintiff fractured his left hip while in the employ of defendant. Compensation was paid from date of injury until April 30, 1962. It was stopped on defendant’s allegation that plaintiff was able to return to work. About May 1, 1962, plaintiff was released to work by the treating physician but when he attempted to regain employe ment from the defendant, he was told that work was slow and he was not re-employed.
