This suit was brought by appellees against appellant for damages for the destruction by appellant of a lien which the complaint alleges the appellees held on a mule.
The evidence, without conflict, showed that one Dunn, with others, executed the mortgage, which was introduced in evidence, in December, 1905, and that the mortgage embraced the mule, the subject of the suit; that appellees were certainly, in equity, the owners of said mortgage, and were entitled to maintain the suit *494as such; that the mortgage was recorded in Geneva county, Alabama, on November 4, 1909.
