OPINION OF THE COURT

Memorandum.

The order of the Appellate Division, insofar as appealed from, should be reversed, with costs, defendant Rome Youth Hockey Association, Inc.’s motion for summary judgment dismissing the complaint as against it granted and the certified question answered in the negative.

Defendant Rome Youth Hockey Association (hereinafter defendant) is a nonprofit community sports organization fully operated by volunteers. In November 2006, defendant rented a local arena owned by the City of Rome to host a hockey tournament for 13-year-old players. Approximately 50-75 spectators…
