*317 Eddonis Kinsey appeals the reinstatement of her probation, following her negotiated guilty plea to the crime of theft by taking, for which she was sentenced under the first offender statute. She argues that the State's motion for probation reinstatement was out of time and that the trial court's reinstatement of her probation subjected her to double jeopardy. For the reasons set forth infra, we reverse.
