This action was begun on June 30, 1880, before a *568justice of the peace, against a constable and the sureties on his bond. The action is brought directly upon the bond. On trial anew in the circuit court, there was judgment against all the defendants.

1. It appears that Lidwell was elected constable of the Fifth Ward of the city of St. Louis, at the November election, 1874. In consequence of the act extending the terms of constables, he was required to give a new bond by the county court, which he did, the bond being approved by the court on December 26, 1876.
