This was an application by the People,1 pursuant to Penal Law § 70.10, requesting that the defendant, who was convicted of the crime of burglary in the third degree, be adjudicated a persistent felony offender.

The defendant was found guilty of the crime of burglary in the second degree, a violent felony, on February 3, 1995, and the People applied for an order treating the defendant as a persistent felony offender. A persistent felony offender hearing was conducted on May 12, 1995, after which the court reserved decision. The People thereafter withdrew…
