In the municipal court of Chicago Emil J. Hartje, defendant in error, recovered a judgment against George Moxley, plaintiff in error, for the sum of $265, for damages to an • automobile belonging to the former, resulting from a collision occurring in that city between that automobile and an automobile owned and driven by the latter; It was charged that the collision and the damages resulted from the fact that Moxley was driving his machine at a high and negligent rate of speed.
