CLARY, District Judge.
This is an action brought by the plaintiff, Lewis W. Knecht, Administrator of the Estate of William J. Knecht, deceased, against the United States to recover damages for the wrongful death of William J. Knecht, a member of the United States Air Force. Suit was instituted pursuant to the provisions of the Federal Tort Claims Act of 1948, as amended, 28 U.S.C.A. § 1346(b). The ease was tried to the Court, sitting without a jury, on May 8,1956.
