delivered the opinion of .the Court.
The plaintiff in error, Ben Cross, was indicted and convicted of murder in the first degree, and the jury fixed his punishment at twenty-one years in the State penitentiary. He has appealed to this court, and has assigned errors.
On the trial of the case the State undertook to prove that the plaintiff in error, before the trial, had made a written confession of his guilt. In the absence of the jury the court heard the evidence as to • said alleged confession, and it appearing that said confession was not made freely and voluntarily, hut was induced by hope…
