OPINION

MURRAY, Justice.

This matter is before the Supreme Court on appeal by the defendant, James M. To-bin, Jr. (Tobin), from his conviction in the Providence County Superior Court. Tobin was found guilty of second-degree sexual assault, G.L.1956 (1981 Reenactment) § 11- 37-4, as amended by P.L.1984, ch. 59, § 1. He was sentenced to twelve years imprisonment, all of which were suspended.
