This appeal requires us to decide whether an attorney's disregard of a court instruction to obtain the official consent of a foreign government to conduct video depositions on its soil constitutes ineffective assistance of counsel per se . A grand jury indicted Hafiz Muhammad Sher Ali Khan; two of his sons, Irfan and Izhar Khan; his daughter, Amina Khan; his grandson, Alam Zeb; and his business associate, Ali Rehman, on terrorism-related charges.
