WAKATSUKI, J.

The Department of Defense of the State of Hawaii (State), employer-appellant, appeals the decision of the Labor and Industrial Relations Appeals Board (Appeals Board) finding claimantappellee, Kazuo Richard Kaya (Kaya), was injured in the performance of his duty as a Hawaii Air National Guard member, and therefore entitled to workers’ compensation benefits under Hawaii Revised Statutes (HRS) § 386-161.

We affirm.
