This is an original action in this court by the relator against respondent in which a mandamus is sought against the Commissioner of the General Land Office of Texas upon the following allegations:

S. C. Martin alleges that he is over 31 years of age and resides in Schleicher County, Texas. John J. Terrell resides in the city of Austin, and is the duly elected and qualified Commissioner of the General Land Office of the State.
