Appeal from an order of the Supreme Court (Keniry, J.), entered May 17, 1996 in Saratoga County, which granted defendant’s motion for summary judgment dismissing the complaint.

On January 4, 1994, plaintiff George Baczkowski (hereinafter plaintiff) was injured while attempting to remove his snowmobile suit in order to urinate outside of defendant’s residence. He allegedly slipped and fell on accumulated snow and ice.
