VAN OOSTERHOUT, Circuit Judge.
The two civil actions here involved, based upon established diversity of citi zenship jurisdiction, arise out of essentially the same facts. The actions were consolidated for trial and were tried to a jury. The jury returned a verdict for plaintiff in each action. Defendant’s motions for directed verdict and for judgment n. o v. were overruled. Defendant has appealed from final judgments entered upon the verdicts.
