Appellee brought this action for recovery of damages on account of personal injuries sustained by operation of a switch engine in the yards of appellant railway company at Booneville, Arkansas, in the early hours of March 19,1944. Appellant railway company, its trustees, and K. R. Briggs, engineer, were made party defendants.
