YOUNG, Justice.

Appellant is here complaining of an adverse jury verdict and judgment in a damage suit brought by appellee Tucker. In making a brief statement of the cause and •its disposition below, we will refer to the parties as they were originally styled. Plaintiff’s action was for personal injuries following an assault made upon him, on June 4, 1938, by Buddy Dyer, an employe of the Beer Company. The petition alleged that said Company was engaged in distribution and sale of beer in Dallas, and employed a number of men for the purpose of making such sales and deliveries, among them being…
