The pertinent point for review is the ruling complained of in the giving of the peremptory instruction to the jury to return a verdict against the plaintiff. It is believed the giving of the peremptory instruction to the jury is not open to the objection of being erroneous and legally unwarranted under the evidence. The subject-matter before the cour1* was a controversy relating purely to a trust, and the evidence bearing thereon was without conflict in the controlling points of the case.
