OPINION

A McMinn County Grand Jury returned a two-count indictment against Kenneth Lee Claiborne. The indictment charged him with murder in the first degree in violation of T.C.A. § 39-2402(2)(e) [killing of a peace officer] and violation of T.C.A. § 39-2402(4) [committing murder in the perpetration of robbery]. Venue was changed to Monroe County upon the defendant’s application. The Monroe County jury found the defendant guilty under the first count (murder of a peace officer); punishment was fixed at death by electrocution.
