HARWOOD, Justice.

This is the second appeal in this case, which involves the adoption of an infant child. The concluding paragraph of the opinion in the first appeal (Williams v. Pope, 281 Ala. 416, 203 So.2d 271, is as follows:

“Based upon the evidence in this record, we would hold that the overwhelming evidence in this case would support a decree in favor of the adoption. But since the trial court improperly excluded evidence required by the statute to be introduced and considered, whether acted upon or not, the decree must be reversed and the cause remanded.
