This is a proceeding pursuant to article 78 of the CPLB wherein a judgment is sought directing the respondents to give a meaningful statement of reasons why release on parole is denied.
The original proceeding was brought by petitioner Thomas A. Cummings (“ Cummings ”). Subsequently, Anthony Di Benadetto (“ Di Benadetto”), Charles Loeicero (“Loeicero”), George Whiteneck (“Whiteneck”) and Clarence Calhoun (“ Calhoun ”) petitioned the court for permission to intervene.
