McCullough v. Maurer
Appellate Division of the Supreme Court of the State of New York
1Opinion of the Court
—In an action to recover damages for personal injuries, etc., the defendants appeal from an order of the Supreme Court, Dutchess County (Bernhard, J.), dated July 20, 1998, which denied their motion for summary judgment dismissing the complaint.
Ordered that the order is affirmed, with costs.
The injured plaintiff was walking her dog in a park when the defendants’ dogs ran toward her unrestrained and dragging their leashes. The defendants’ dogs jumped on the injured plaintiff’s dog and, in the ensuing confusion, the injured *570plaintiff became entangled in the leashes and fell, injuring herself.
