LARSON, Justice.
This is an appeal by lone Lamantia from an order of the district court sustaining the appellees’ combined motions for judgment on the pleadings and summary judgment. Because the appellant has sufficiently stated a claim for relief in her petition and a genuine issue of material fact exists, we hold that the motion for judgment on the *246pleadings should have been overruled and that the motion for summary judgment should have been denied insofar as it sought dismissal of the appellant’s claim in its entirety.
