The appellant, Kendarius Lamond Peak, was indicted by a Jefferson County grand jury for three counts of capital murder. Specifically, Peak was charged with the capital offense of murder committed during a first-degree burglary or an attempt thereof, see § 13A-5-40(a)(4), Ala.Code 1975; the capital offense of murder committed during a first-degree robbery or an attempt thereof, see § 13A-5-40(a)(2), Ala.
