The exceptions presented by the record will be considered in the order in which they have been argued.
I. The defendant’s counsel objected to the witness testifying what Jean Petit & Son stated to him — when he visited their place of business, No. 7 Rue de la Mecorcher — in regard to the prices of champagne. The testimony is objected to as inadmissible and incompetent, on the ground that it was hearsay, and that there was no evidence that Petit & Son were the agents of the claimant.
