Appellant was charged by indictment with the unlawful killing of Hope Elizondo, and upon his trial was by the jury found guilty and assessed the penalty of death.
It appears from the facts that Hope Elizondo was a little Mexican girl of the age of eleven years; that she attended a local school near La Vernia in said county, and at times was taken to such school by her father; at other times she walked, following a trail through some pastures.
