This case is before the court for consideration of the plaintiff Chattooga River Watershed Coalition’s motion for summary judgment [14-1]. On March 22, 1998, the court conducted a telephone conference with the parties. The parties agreed that no discovery was necessary and that the issues could be decided on the briefs. As a result, the court approved the Joint Preliminary Planning Report and Scheduling Order, directed the defendants to file the administrative record, and set a briefing schedule for the parties.
