This court's opinion of March 11, 2005, is withdrawn, and the following opinion is substituted therefor:

The Alabama State Board of Medical Examiners (hereinafter "the Board") filed an administrative complaint before the Medical Licensure Commission of Alabama ("the Commission") against Pascual Herrera, Jr., M.D. In its complaint, the Board sought the revocation of Dr. Herrera's license to practice medicine in the State of Alabama.
