Helen Clendenin, on the 9th day of May, 1872, died testate as to her personal property only, in Cass county, in this State, seized of certain real estate there situate, and by her will bequeathed a legacy of $1000 to her sister, Catharine P. Schooley.

This bill in equity was filed by appellee, the executor named in the will, for a construction of the will, and to subject said real estate to the payment of the remainder of the legacy, ($200 having been paid thereon.) upon the allegation that the personal estate was insufficient to discharge the same.
