The facts agreed upon by the parties are as follows : By an act of the legislature, passed in 1836, (Sess. Laws of 1836, p. 361,) the Castleton and West Stockbridge Rail Road Company was authorized to make the western termination of its road at a point opposite to the city of Albany, in the town of Greenbush, and the name of the corporation was changed to the Albany and West Stockbridge Rail Road Company.
