Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Albany *911County) to review a determination of the State Tax Commission which sustained a personal income tax assessment imposed pursuant to article 22 of the Tax Law. From 1963 until his resignation on September 25, 1970, petitioner was retained as the attorney for clients with whom he invested funds, and served as a stockholder, director and secretary-treasurer of their business, Cardinal Air Service Corporation.
