Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court, entered in Albany County) to review a determination of respondent Superintendent of State Police which found petitioner guilty of violating certain regulations of the State Police.

On December 22, 1987, an altercation between petitioner, a sergeant in the State Police, and his wife, Donna Douglas, in their home resulted in injuries to Douglas, for the treatment of which petitioner took her to a local hospital.
